1. Introduction

Welcome to the WISHES FOR WHEELS program provided by APEX Mobility and Motion Composites Inc. By participating in this program, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1.1. Key Dates

1.2. How to Apply

2. Service Description

WISHES FOR WHEELS is a program that aims to provide a high-end Motion Composites ultralight, adjustable wheelchairs to deserving individuals who may not otherwise have access to one. 

2.1 Inclusions

The following parts will be included in the delivery of the program if determined appropriate for the wheelchair user by the evaluating professionals:
•    Manual Wheelchair base from the Motion Composites range that is distributed by APEX Mobility in Australia.
•    Components, accessories and parts compatible with the wheelchair model and offered by Motion Composites Inc.
•    NXT cushion and back support as offered by Motion Composites.

2.2 Exclusions

The following parts are not included in the WISHES FOR WHEELS program.
•    Spinergy products (no upgrade available)
•    Custom requests
•    APEX Mobility is not responsible for acquiring any 3rd party accessories not on the order form that is not listed above.
•    Cannot be a past recipient of the WISHES FOR WHEELS program.
•    Change in functional mobility status, condition or funding availability during the process from time of application to time of selection.
•    Following recipient selection, the assessment, with the supplier or dealer, wheelchair order, final delivery, and fitting must be completed within three (3) months. At the two (2) month mark, APEX Mobility reserves the right to review the status of the process. If insufficient progress has been made, APEX Mobility may, at its sole discretion, cancel the current recipient’s participation and move onto the next.

3. Eligibility
To apply, individuals must:
•    Reside in Australia.
•    Be a current manual wheelchair user OR not currently have access to an appropriate manual wheelchair, for any reason, and where the lack of access significantly limits independence or quality of life.
•    Be unable to access, fund or have funding for a high-quality, ultralight manual wheelchair
•    Clearly demonstrate how a Motion Composites manual wheelchair would enhance their mobility and quality of life.
•    Be appropriate for the assistive technology being offered (i.e., specific product limitations and weight capacity) as determined by associated professionals.

4. Process and Requirements

Application Review Procedure:  All applications will be reviewed using the information provided in the Wishes for Wheels Application Form, and suitability as a recipient will be determined based on the details submitted. If critical information is missing, incomplete, or unclear, this may affect the outcome of the application. As such, Wishes for Wheels cannot be held accountable for decisions made where essential details were not supplied.

To ensure fairness and accuracy, we may also contact individuals, organisations, or professionals listed in the application to clarify information or request further details. Any additional questions or documentation requested must be provided within the specified timeframe for the application to remain under consideration.

Recipient Selection Procedure:  The recipient selection process for the Wishes for Wheels program is designed to ensure fairness, transparency, and alignment with the program’s values. Each application is carefully reviewed and evaluated against the program’s eligibility and selection criteria. Applications are scored across five weighted categories: Eligibility Compliance (20%), which covers residency requirements, manual wheelchair user status, inaccessibility of funding, and appropriate fit; Impact on Quality of Life and Mobility (25%), which considers how a Motion Composites wheelchair would significantly enhance independence and daily living; Compelling Personal Story (25%), which assesses authenticity, need, and potential for meaningful transformation; Readiness and Commitment (15%), which reflects the applicant’s readiness for fitting, commitment to program timelines, and availability for delivery; and Alignment with Program Values (15%), which evaluates how well the applicant reflects APEX Mobility and Motion Composites’ values of empowerment, community, and dignity.

Each application is scored independently by a review panel made up of Occupational Therapists, Physiotherapists, and Mobility Assistive Technology Scripting Consultants. Panel members submit their scores individually, without influence from others. Once this stage is complete, the panel meets as a group to discuss their assessments, share the reasoning behind their scores, and determine final scores for each applicant. At this stage, shortlisted candidates may also be contacted to clarify any outstanding details or provide further information.

When the final shortlist has been established, the panel lead calls a meeting with the Executive Team at APEX Mobility, including the CEO, Directors, and Management Team. During this meeting, the panel lead presents an overview of all applications, the final panel scores, the reasoning behind each score, and a formal recommendation for the proposed recipient. The Executive Team then reviews the recommendation and discusses the findings before making a final decision. The decision is only confirmed once it has been formally signed off by the Executive Team.

If the Executive Team cannot reach consensus, the evaluation process restarts from the panel scoring stage and continues until a unanimous decision is reached. This ensures that the final recipient is selected through a thorough, transparent, and collaborative process that reflects the values of the Wishes for Wheels program.

Assessment & Fitting Procedure: All recipients of the Wishes for Wheels program must undergo a professional assessment to confirm the appropriate wheelchair, seating, and component specifications. This assessment ensures that the selected equipment meets the user’s individual needs for mobility, comfort, and independence. An Occupational Therapist from the APEX Mobility team must be present during the assessment, either in person or virtually, to provide guidance and oversight throughout the process.

The outcomes of the assessment must be documented and submitted using the official wheelchair scripting form. Completed forms will be uploaded into the APEX ordering system to ensure all specifications are accurately recorded and communicated for production.

Once the assessment is complete and the order submitted, the wheelchair will be delivered to APEX Mobility Head Office. Upon arrival, the wheelchair user and APEX Mobility representatives - including Occupational Therapists and/or Assistive Mobility Technology Scripting Consultants - will meet to deliver the wheelchair and complete the final fitting and set-up adjustments. This ensures that the wheelchair is optimally configured to the user’s needs and ready for immediate use.

This structured process guarantees that each recipient receives a wheelchair that is safe, comfortable, and fully tailored to enhance their mobility and independence.

5. Involvement of Third Parties

Any third-party therapists and / or assistive technology supplier involved in the recipient’s care may be invited to participate in the Wishes for Wheels project; however, their role will be assisting in nature only. The Occupational Therapist and Assistive Mobility Technology Scripting Consultants from APEX Mobility retain final authority over all script requirements, measurements, and recommendations for the recipient. Any recommendations from a third-party therapist or assistive technology supplier must be discussed with the recipient and APEX Mobility representatives at the time of assessment. Changes to the script recommendations provided by APEX representatives may not always be possible and, if accommodated, could result in delays to the final delivery

The Marketing Team at APEX Mobility determines the level of marketing exposure and key messaging regarding any third-party therapists or assistive technology suppliers involved in the recipient’s care. APEX Mobility reserves the first right to announce the recipient and their story, and any marketing materials or communications from third parties must receive prior approval from the APEX Mobility Marketing Team before release.

5.1 Maintenance and Care

Recipients are responsible for the proper maintenance and care of the products provided. Instructions for care and maintenance will be provided upon delivery. User manuals are also available at all times on Motion Composites Inc.’s website: www.motioncomposites.com.

5.2 Disposal of Current Equipment

If a program recipient’s previous wheelchair or equipment becomes obsolete, the recipient is responsible for the safe and environmentally responsible disposal of the product.

6. APEX Mobility and Motion Composites Inc. Responsibilities

6.1 Quality Assurance
Motion Composites Inc. guarantees that the products provided will be of Motion Composites’ current high-quality standard.

6.2 Support
APEX Mobility will provide staff for the evaluation, fitting, and delivery, including troubleshooting and additional assistance as needed. Contact APEX Mobility at any time using the contact information specified in Section 12 below.

In the event that APEX Mobility is unable to provide assistance, we reserve the right to refer the client and/or their care team to one of our approved dealer partners to provide the necessary support.

7. Financial Terms

Cost: This program is at no cost to the wheelchair user.
•    Any 3rd party therapists and / or assistive technology supplier will not be compensated for the time / effort on evaluation / fitting / delivery and will not charge the wheelchair user if they wish to be involved.
•    The wheelchair user is responsible for the cost of any additional items not included in the program.
•    Charges may apply to the wheelchair user for repairs / warranty beyond original delivery / fitting.

8. Warranty and Liability

Repairs and Warranty
•    Wheelchair: All originally prescribed parts and accessories through normal wear and tear are covered under warranty for 5 years past the day of original delivery. Repairs that are the result of abusive use of the chair are not covered.
•    Seating: Replacement of original seating products: One time within 5 years
•    Dealers can charge labour costs to wheelchair users for repairs and warranty.

8.1 Warranty

Motion Composites Inc. provides a warranty on the wheelchair against manufacturing and workmanship defects. The warranty consists of a replacement or repair of the product or parts according to the applicable limited warranty certificate and does not cover damage due to incorrect installation by an unqualified person, misuse or abnormal use of the wheelchair.

8.2.1 Liability
APEX Mobility and Motion Composites Inc. is not liable for any damages arising from incorrect installation or by a non-qualified person or misuse of the wheelchair. Users must diligently follow all provided instructions and guidelines.

8.2.2 Responsibility
APEX Mobility and Motion Composites Inc is not responsible for any incident or injury resulting from the unauthorised modification of the wheelchair, or the use of the parts in assemblies or devices not approved by Motion Composites Inc.

9. Returns and Exchanges

Due to the nature of the program, returns and exchanges are not allowed for the program with the exception of warranty repairs.

10. Legal

This document shall be governed by and construed in accordance with the laws of New South Wales, Australia.

11. Privacy and Data Protection

11.1 Data Usage

User data will be used solely for the WISHES FOR WHEELS program. Data will be stored securely and will not be shared with third parties without user consent.  By entering the promotion, you give APEX Mobility consent to use your name, photo(s), videos, and personal story on our various marketing channels.  This may include (but is not limited to) our website, social media platforms, email campaigns, and printed materials, with the goal of promoting the program and raising awareness of its impact.  By participating in the program, you provide consent for this information to be used by APEX Mobility and its partners for promotional purposes.

12. Dispute Resolution

12.1 Resolution Process
In the event of a dispute, users should contact APEX Mobility to seek resolution. APEX Mobility will make reasonable efforts to resolve any issues promptly.

12.2 Jurisdiction
Any disputes arising out of or in connection with this document and or its performance shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia. 

12.3 Program availability
APEX Mobility and Motion Composites Inc. may modify or cancel this program at any time.
